上海外国人来华工作许可有关事项实行全程网上办理“不见面”审批的通知

为加强新型冠状病毒感染的肺炎疫情的防控工作，有效减少人员聚集，实现网上快捷办事、平安办事、健康办事，更好地保障本市人民群众生命安全和身体健康，现将有关事项通知如下：
In order to strengthen the prevention and control of pneumonia caused by new coronavirus infection, effectively reduce the number of people gathered, achieve quick, safe and healthy online services, and better protect the life safety and physical health of the people in this city, the relevant matters are hereby notified as follows:
一、为更好地配合疫情防控，方便各用人单位在网上办理行政许可相关手续，防控期间，特暂时调整本市外国人来华工作许可有关事项的审批流程，实行“不见面”审批。对需要办理《外国人来华工作许可通知》(B类和C类)、《外国人工作许可证》延期(B类和C类)及所有注销业务，用人单位可采用“承诺制”实现全程网上办理，无需到现场提交纸质材料核验。其他涉及外国高端人才办理《外国人来华工作许可通知》及《外国人工作许可证》延期、办理《外国人工作许可证》变更等业务仍维持原有流程不变，无需到现场提交纸质材料核验。
1、 In order to better cooperate with the epidemic prevention and control, and facilitate the employers to go through the relevant formalities of administrative license on the Internet, the approval process of work permit related matters of foreigners in this city is temporarily adjusted during the prevention and control period, and the approval of "do not meet" is implemented. For the foreigner’s work permit notice (class B and C), the foreigner’s work permit extension (class B and C) and all cancellation businesses that need to be handled, the employer can use the "commitment system" to realize the whole process online processing, without the need to submit paper materials to the site for verification. Other businesses involving foreign high-end talents in handling the notice of foreigner's work permit to China, the extension of foreigner's work permit, the change of foreigner's work permit, etc. still maintain the original process, without the need to submit paper materials to the site for verification.
二、建议已获得《外国人来华工作许可通知》但尚未入境的外国人，尽量在我国驻外使领馆办理工作签证(Z字)，取得Z字签证(Z字签证有效期一般为3个月)后可根据实际情况在有效期内安排来华行程。同时,针对在疫情防控期前外国人已办理了Z字签证，因疫情原因延迟来沪，导致Z字签证过期，待疫情结束后，如外国人持其他签证入境，用人单位在提交相关情况说明予以认可。
2、It is suggested that foreigners who have obtained the notice of work permit for foreigners to come to China but have not yet entered China should apply for work visa (z) at Chinese Embassy . After obtaining Z visa (Z visa is generally valid for 3 months), they can arrange their trip to China within the valid period according to the actual situation. At the same time, those foreigners who had applied for Z visa before the epidemic prevention and control period, the Z visa expired due to the delay in coming to Shanghai led by the epidemic. After the epidemic, if foreigners enter China with other visas, the employer shall submit relevant information for approval.
三、审批机关要加强事中事后监管, 建立用人单位诚信档案和虚假承诺异常名单。用人单位应确保提交的材料真实有效，积极配合做好事中事后监管的核查工作。对提供虚假材料或无法提供要件原件的，审批机关将视情形给予不同处理：如不再适用任何承诺审批(包括薪资承诺、123服务承诺等);暂缓用人单位及代办机构办理外国人来华工作许可业务等。以欺骗手段取得行政许可，审批机关有权依法取消行政决定。
3、The examination and approval authorities should strengthen the supervision during and after the process, and establish the employer's good faith files and the list of false promises. The employer shall ensure that the submitted materials are true and effective, and proactively cooperate in the verification of post supervision. For those who provide false materials or fail to provide the original materials, the examination and approval authority will give different treatment according to the situation: for example, no longer apply to any commitment examination and approval (including salary commitment, 123 service commitment, etc.); suspend the employer and the agency to handle the work permit business for foreigners in China, etc. If an administrative license is obtained by deception, the examination and approval authority shall have the right to cancel the administrative decision according to law.
四、为避免交叉感染，遏制疫情传播，针对有些业务及操作办理等问题，用人单位可通过电话热线、科技微信、网站留言等方式进行咨询。电话服务热线：8008205114(座机)4008205114(手机)。

五、用人单位到受理窗口现场办理业务时，请自觉并正确佩戴口罩，做好自身防护;若出现新型冠状病毒感染可疑症状，如发热、咳嗽、咽痛、胸闷等，请及时告知工作人员并停止办理;离开受理窗口时，请将所有材料和废弃口罩一并带离。
5、When the employer goes to the acceptance window to handle business, please wear the mask consciously and correctly, and do a good job of self-protection; in case of suspected symptoms of new coronavirus infection, such as fever, cough, sore throat, chest tightness, etc., please inform the staff in time and stop handling; when leaving the acceptance window, please take away all materials and waste masks.
本通知自印发之日起执行。待疫情结束后，另行通知终止执行时间。
This notice shall be implemented as of the date of issuance. After the end of the epidemic, the execution time shall be notified separately.
