Guide to Replacement of the Previous Foreigners Expert Certificate or the Foreigners Employment Permit for the Work Permit for Foreigners

n Basic Requirements for Employers
1、依法设立，有实际经营场所、依法纳税、缴纳社会保险、无严重违法失信记录；聘用外国人从事的岗位应是有特殊需要，国内暂缺适当人选，且不违反国家有关规定的岗位；支付所聘用外国人的工资、薪金不得低于当地最低工资标准。
1. Employers shall be established by law with actual business premises, pay taxes and social insurances according to law, without serious illegal and dishonest acts; the employment of foreigners shall be for special needs and the appropriate candidates are in short supply domestically in China; the salary or remuneration for those foreigners shall not be lower than the local minimum wage.
2、法律法规规定应由行业主管部门前置审批的，需经过批准。
2. For pre-approval by the industry competent authority by law, it shall be approved.
n  申请人基本条件
n  Basic Requirements for Applicants
持有效期内的《外国专家证》或《外国人就业证》，且工作类居留许可在有效期内的外籍人士。
Foreign nationals with a valid Foreigners Expert Certificate or Foreigners Employment Permit, and a valid work-type residence permit.
u  申办程序
u  Application Procedure
1、进入外国人来华工作管理服务系统https://fwp.safea.gov.cn；也可直接登陆科学技术部政务服务平台https://fuwu.most.gov.cn进入外国人来华工作管理服务系统。
1. Please directly access to the Service System for Foreigners Working in Chinahttps://fwp.safea.gov.cn; or access to it via the government affairs service platform of the Ministry of Science and Technology at https://fuwu.most.gov.cn
2、用人单位进入账户，按操作办法相关情形所示进行申请。如实填写申请人的基本信息、教育背景、工作经历、申请信息等内容并上传所需材料原件。
2. The employer shall complete the application procedures as instructed after entering the account. The employer shall truthfully fill in the applicant’s basic information, education background, work experience, application information, etc., and upload the original documents required.
3、上传所有材料原件后，即可提交等待预审，预审通过后，用人单位需持上传的所有书面材料原件（所有非中文材料均需翻译成中文并加盖单位公章）至窗口核验受理。
3. After uploading all the original documents, the employer can submit them for preliminary review; upon approval, the employer shall take all the original paper documents uploaded (all non-Chinese documents must be translated into Chinese and affixed with the official seal of the employer) to the window for verification and reception.
u  提供材料标准
u  Requirements for Documents Provided
1、所有纸质材料彩色原件及中文翻译件均须以电子方式上传至外国人来华工作管理服务系统。
1. All paper versions of original documents and the translated versions must be electronically uploaded in color to the Service System for Foreigners Working in China.
2、非中文证明材料均需提供中文翻译件，并加盖用人单位公章（护照或国际旅行证件除外）。
2. Non-Chinese credentials shall be translated into Chinese and stamped with the official seal of the employer (except for passports and international travel certificates).

1、单位换证申请函（加盖公章）；
1. Application Form for Replacement (with the Official Seal of the Employer);
2、外国人来华工作许可申请表；
2. Application Form for Foreigners Work Permit;
3、申请人护照及有效的工作类居留许可；
3. Applicant’s passport and valid work-type residence permit;
4、有效期内的《外国专家证》或《外国人就业证》；
4. Valid Foreigners Expert Certificate or the Foreigners Employment Permit;
5、发证机关认为需要的其他证明材料。

u  Notes:
1、外国人工作许可申请表系统自动生成，用人单位打印后加盖公章，并由申请人签字，再原件上传至“附件”。
1. The employer shall print out and stamp on the automatically issued Application Form for Foreigners Work Permit signed by the applicant and upload its original to Annex.
2、《外国专家证》须上传个人信息页及最新有效期页；《外国人就业证》：须上传个人信息页、最新有效期页及上一年度年检页；在附件—“其他”一栏中上传。
2. The documents that shall be uploaded to “Others” in the Annex: personal information page and the latest validity page of the Foreigners Expert Certificate; the personal information page, the latest validity page, and the annual inspection page of the previous year of the Foreigners Employment Permit.
3、持有效期内《外国专家证》或《外国人就业证》的换证，默认为外国专业人才；如申请人满足外国高端人才标准，用人单位需提交相关证明材料并在系统内“其他材料”中上传相应的证明材料。
3. The applicants with a valid Foreigners Expert Certificate or Foreigners Employment Permit who apply for replacement shall be defaulted as Foreign Professionals; if the applicant meets the criteria for foreign high-end talents. The employer shall submit the relevant credentials and upload them to “Other Documents” in the system.

1、预审期限：5个工作日（以提交完整并符合要求的材料为准）
1. Preliminarily review period: Five working days (after the complete and qualified documents are submitted)
2、  审查期限： 5个工作日 （以受理窗口核验书面材料原件并确认无误为准）
