Guide to Extension of the Work Permit for Foreigners

办事依据 
Law Bases
1、《中华人民共和国行政许可法》。
1. Administrative License Law of the People’s Republic of China.
2、《中华人民共和国出境入境管理法》第四十一条规定:外国人在中国境内工作,应当按照规定取得工作许可和工作类居留证件。任何单位和个人不得聘用未取得工作许可和工作类居留证件的外国人。
2. Article 41 under the Exit and Entry Administration Law of the People’s Republic of China: Foreigners who work in China shall obtain work permits and work-type residence permits in accordance with relevant regulations. No entities or individuals shall employ foreigners who
 have no work permits or work-type residence permits.
3、《中华人民共和国外国人入境出境管理条例》第七条规定:申请R字签证,应当符合中国政府有关主管部门确定的外国高层次人才和急需紧缺专门人才的引进条件和要求,并按照规定提交相应的证明材料。申请Z字签证,应当按照规定提交工作许可等证明材料。
3. Article 7 under The Regulations of the People’s Republic of China on Administration of the Entry and Exit of Foreigners: To apply for the R visa, the applicant shall meet the qualifications and requirements set by the competent authorities of the Chinese government for inviting persons of high talent or urgently needed specialists, and the applicant shall, in accordance with relevant provisions, submit the relevant certification documents; To apply for the Z visa, the applicant shall, in accordance with relevant provisions, submit the work permit and other certification documents.
第十六条规定:工作类居留证件,应当提交工作许可等证明材料;属于国家
需要的外国高层次人才和急需紧缺专门人才的,应当按照规定提交有关证明材料。
Article 16: To apply for a work-type residence permit, the applicant shall submit such certification documents as a work permit; in the case of a person of high talent who is needed or, a specialist who is urgently needed, by the State, the applicant shall submit relevant certification documents in accordance with relevant provisions.
4、国务院审改办《关于整合外国人来华工作许可事项意见的函》(审改办函〔2015〕95号)。
4. Letter of Opinions on the Integration of Work Permit for Foreigners by the Office for Administrative Examination and Approval System Reform under State Council (SGBH <2015> No. 95).
提供材料标准
Requirements for Documents Provided
1、所有纸质材料原件及中文翻译件均须以电子方式上传至外国人来华工作管理服务系统。
1. All paper versions of original documents and the translated versions must be electronically uploaded to the Service System for Foreigners Working in China.
2、非中文证明材料均需提供中文翻译件,并加盖用人单位公章(护照或国际旅行证件除外)。
2. Non-Chinese credentials shall be translated into Chinese and stamped with the official seal of the employer (except for passports and international travel certificates).
3、外国高端人才(A类)申请人无需提交纸质材料核验,通过薪资承诺的外国高端人才(A类)申请人及外国专业人才(B类)申请人提交所有上传材料原件到受理窗口核验。
3. Foreign High-end Talents (Category A) have no need to submit paper documents for verification, while Foreign High-end Talents (Category A) through salary commitment and Foreign Professionals (Category B) shall submit the originals of all the documents uploaded at the reception window for verification.
所需材料
Documents Required
1、外国人来华工作许可延期申请表:在线填写打印,申请人签字后,加盖用人单位公章或经单位授权部门公章上传至系统。
1. Application Form for Extension of Foreigners Work Permit: Fill in the online application - print it out - send to the applicant for signing- stamp it with the employer’s seal - upload it to the system.
2、聘用合同或任职证明:中文合同、任职证明或派遣函。
2. Employment contract or employment certificate: Contract in Chinese, employment certificate, or dispatch letter.
3、申请人护照或国际旅行证件:护照或国际旅行证件信息页。
3. Passport or international travel certificate: Information page of the passport or of the international travel certificate.
4、申请人有效居留许可:居留许可信息页。
4. Applicant’s valid residence permit: Information page of the residence permit.
5、其他材料:许可受理机构或决定机构根据需要要求进行补充提供的材料。
5. Other documents: Documents provided as required by the reception authority or the decision-making authority.
注意事项
Notes:
1、用人单位在原岗位(职业)继续聘用申请人的,应当在申请人的来华工作许可有效期届满30日前向决定机构提出申请。
1. If the employer continues to employ the applicant at the same position (occupation), it shall submit the application to the decision-making authority 30 days or more before the expiration date of the applicant’s work permit.
2、外国高端人才(A类)通过薪资承诺申请延期的,需提交相应证明材料。
2. Foreign High-end Talents (Category A) who apply for an extension through salary commitment shall submit the relevant certificate.
3、我国法律法规规定应由行业主管部门前置审批,应提供行业主管部门批准文书。
3. For pre-approval by the industry competent authority by law, an approval document of the industry competent authority shall be provided.
4、自许可作出决定之日起10日内,用人单位凭《外国人工作许可证》和打印的受理电子回执单到受理机构更新《外国人工作许可证》芯片信息。
4. The employer shall update the chip information of the Work Permit for Foreigners, with the Work Permit for Foreigners and the printed electronic receipt within ten days from the date on which the permit is approved.

6、委托专门服务机构代办的,专门服务机构具体办理许可申请、延期、变更、注销、补办业务,需提交用人单位授权委托书,明确受委托单位及具体受委托人、委托事项,并填写受委托人身份证号及联系电话,一人一事一委托。
6. Those professional service agencies authorized with the procedure of application, extension, changing, cancellation, or re-submission shall submit the Letter of Authorization of the employer, in which the authorized entity, the authorized person and his/her ID number and telephone number, and the authorized matters shall be clearly specified. That is, the professional service agency, the authorized person and the corresponding authorized matters shall be clearly specified.
审批期限
Examination and Approval Period
1、预审期限:5个工作日
1. Preliminarily review period: Five working days
以提交完整并符合要求的材料为准,外国高端人才(A类)(薪资承诺除外)预审与受理一并处理。
After the complete and qualified documents are submitted, including preliminary review and reception for Foreign High-end Talents (Category A) (except for those through salary commitment.
2、审查期限:5个工作日
2. Review period: Five working days
外国高端人才(A类)以网上受理材料为准,薪资承诺的外国高端人才(A类)及外国专业人才(B类)以受理窗口核验书面材料原件并确认无误为准。
For Foreign High-end Talents (Category A), after the documents are received online; for Foreign High-end Talents (Category A) through salary commitment and Foreign Professionals (Category B), after the originals of the paper documents are verified and confirmed at the reception window.
遇特殊情况需延长期限的,许可受理机构或决定机构将酌情处理。
In case of special circumstances requiring an extension of time limit, the reception authority or the decision-making authority shall handle the matter as appropriate.
